Personal information does include the name, title, business address, or business telephone number of an employee of an organization (“Personal Information”). The terms “Elate”, “we”, “us” and “our” means Elate, LLC. “You” and “Your” means the individual who is a customer by virtue of viewing our materials or using our online services.

During normal website usage, you can visit our site without communicating any personal information. However, to make use of certain features on our site, such as purchasing products, advertisements, promotions, personalized services, paid subscriptions or newsletters, users may be asked to register with us. As part of this voluntary registration, we may request contact information (such as name, mailing address, physical address, date of birth, social security number, bank account, email address, etc.) and other data required for operating these services. We may only collect personal information from you if you voluntarily provide it. You are under no obligation to provide us with personal information, and You may access and enjoy many parts of our website without providing us any personal information. (a) Information Elate or Elate Services May Share. In order for Elate to provide Elate Services, you permit Elate or Elate Services to disclose to apps and websites that you have set up Elate and Elate Services, and to share your device, payment, location, and account information with your payment method's issuer and network. You also permit Elate and Elate Services to share your personal information with merchants, payment providers, payment processors, and other third parties.

(b) Information Elate or Elate Services May Collect. As permitted in our privacy policies, and in order for Elate or Elate Services to provide and improve its services, you permit Elate and Elate Services to collect transaction, account, and other personal information from third parties, including merchants and your payment method's issuer.

(c) Elate's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements

If You object to information about you being shared with these third parties, please uninstall the app.

Our Relationship with You

In situations where our users are subject to our Subscriber Agreement, Enterprise Master Services Agreement, or other Master Services Agreement to use Grux's services, Grux is the processor/service provider and our customer is the controller/business of the information provided to Grux. In all other cases, Grux is the controller of the information.

For example, if you create an account with your corporate email address, your company is the controller of your Grux Workspace and the information stored in it. If you create an account with a free email domain or personal email account, Grux is the controller of your Workspace.

If you’re using Grux through your company, educational institution, or with your company email address, your administrator is responsible for the accounts associated with that organization. They can restrict, suspend, or terminate your access, access information about you, access or retain information stored with us, and restrict your ability to edit, restrict, modify, or delete information associated with your use of our products.

Information We Process

Grux processes information we receive directly from you, automatically collected when you use Grux or visit one of our websites, and collected by Grux from third parties. This Privacy Statement does not apply to the processing of your information by third parties through your use of any third-party integrations available via our services. Please visit those third-party websites directly for more information on their privacy and data protection practices.

Information Grux Receives Directly From You

This includes information needed to create an account and manage your ability to log in and out of Grux:

  • Identifiers, including first and last name and email address.
  • Your hashed password for Grux.
  • Information related to a third-party authentication identity provider.
  • Billing information, including name, address, and telephone number for paid accounts.
  • Financial information, such as credit card or bank account information collected by our payment processors.
  • Information about your chosen Grux plan.
  • Information you provide in Grux software or upload as attachments.
  • Information from emails you forward to Grux.
  • Profile photos and other descriptive information you voluntarily provide.
  • Video and audio recordings, and transcripts of those recordings.
  • Professional or employment information.
  • Any other information you choose to provide while using Grux that identifies you.
  • Requests, questions, and responses provided via forms or email.
  • Information provided in connection with sweepstakes, contests, or research studies.
  • Information to verify your identity.
  • Geographic and social media information.
  • Your date of birth and biometric information associated with call recordings.

Information automatically processed when you visit our websites or use our mobile, desktop, or Chrome Extension apps

We may also collect the following:

  • Information collected via the Grux Chrome Extension: When you use our Chrome Extension, we only collect specific data required for its the functionality you enable. The only required information to use the Grux Chrome Extension is Google basic profile information (name and email). The following data that is used when optional features are enabled within the extension:
    • Google Workspace Data: Data accessed via authorized Google OAuth scopes, including basic profile information (name and email), Google Drive files and metadata (including labels), Gmail metadata and thread associations for shared inbox functionality, Google Chat spaces and messages, Google Tasks data, and Google Calendar event details.
    • Browsing Context: Active tab URLs and visible webpage content, collected strictly when you manually initiate a contextual chat thread.
    • Media Capture Data: Screen captures (partial, visible area, or full page), video recordings of your active tab or entire desktop, and camera/microphone inputs, collected only when you explicitly activate the screen capture or video recording tools.
    • Device and Authentication Data: IP addresses and device information, captured upon login and retained for up to 90 days for account recovery, authentication tracking, and security purposes.
  • Metadata and inference information related to your use of Grux, our websites, and third-party integrations.
  • Logs of the actions you take as you use Grux, including workspaces used, tasks assigned, features viewed, and third-party integrations used.
  • Internet network activity, cookies, and similar tracking technologies.
  • Information collected as a result of participation in beta testing.
  • Information about how you interact with our marketing websites.
  • Device information and activity when you use Grux via a mobile device.
  • Derived device geolocation information inferred from an IP address.

Information Grux Receives from Other Sources

Sometimes Grux receives your information from third parties, which may include:

  • Information processed from third-party integrations you set up with Grux.
  • Name, email, and business contact information.
  • Information about you provided to us from other individuals or users of Grux.

How We Use Your Information

Grux uses your information to operate our products and services, communicate with you, process transactions, for security and fraud prevention, and to comply with the law.

Chrome Web Store Limited Use Disclosure: The Grux Chrome Extension's use and transfer to any other app of information received from Google APIs will adhere to the Chrome Web Store User Data Policy, including the Limited Use requirements.

Specifically, we may process your information to:

  • Provide services to you and operate our business.
  • Maintain, provide, and improve our products and services.
  • Suggest relevant Grux Help Center articles.
  • Help us better understand user interests and customize Grux.
  • Analyze and research how you interact with our websites and applications.
  • Protect Grux and you by securing systems against fraud, identifying bugs, and complying with global laws.
  • Investigate alleged violations of our User Terms of Service.
  • Comply with valid legal subpoenas, requests, or other lawful processes.
  • Communicate with you about Grux, provide important updates, and market services to you.
  • Advertise Grux to you.
  • Facilitate reporting and analyze platform performance.
  • Provide webinars, public presentations, or demos.
  • Process your information at your direction.
  • Provide cross-device management of your account.
  • Provide you with support, resolve requests, and get your feedback.
  • Survey your opinions through research studies.

Combined Information, Aggregated Data, and AI

Unless prohibited by law, we may combine collected information with data from other sources. We may aggregate and/or de-identify information related to your use of Grux so it can no longer be linked to you, and use it for research and marketing purposes.

Some features in Grux are powered by artificial intelligence (AI) and machine learning. Admins can adjust AI preferences for your workspace at any time. We use metadata related to your workspace use to train machine learning models, but our third-party LLM service providers do not use customer data to train their models. Integrations such as Google Workspace APIs are not used to develop, improve, or train generalized AI models.

How We Disclose Your Information

We need to disclose the information we collect to operate our business under the following conditions:

  • Service providers and subprocessors: We may provide access to select third parties that assist in providing Grux's services, such as sales, marketing, analytics, and security.
  • Advertising partners: We may provide information collected when you visit an Grux website to service providers to provide you with more relevant Grux ads. Our advertising partners may also use cookies on our website.
  • Exception for Chrome Extension Data: Notwithstanding the above, no user data, browsing activity, or permissions collected specifically through the Grux Chrome Extension are ever sold, transferred, or used for personalized advertising, credit-worthiness evaluations, or shared with data brokers.
  • Because you ask us to disclose: When you connect Grux with other tools via our integrations.
  • Consistent with your settings: Information you submit to Grux may be viewable by other users in your workspace.
  • Affiliates and subsidiaries: We may disclose information within the Grux family of companies.
  • Business transfers: If ownership of our business changes, we may transfer your information to the new owner.
  • Compliance with legal obligations: To comply with legal requests meeting our Law Enforcement Guidelines.
  • Your company’s administrator: Administrators can export data associated with the Workspace they manage.
  • Public Forums: Information submitted through public forums is not confidential and may be available to the public.

We do not disclose your information to third parties for their own direct marketing purposes.

Protection, Storage, Transfer and Retention

Grux takes technical and organizational measures to protect your information, though no method of transmission is absolutely secure. Some information about you will be stored in the United States, where the majority of Grux's data processing occurs.

Grux adheres to the EU-US Data Privacy Framework Principles, the UK Extension, and the Swiss-US Data Privacy Framework program. We commit to refer unresolved complaints to BBB National Programs. We will retain your information for the period necessary to fulfill the purposes outlined in this statement unless a longer retention period is required by law.

Other Important Information

  • Children under 16: We do not knowingly process information from children under 16.
  • Marketing Practices: You may instruct us not to use your contact information for marketing by using the chat option on our website, or by unsubscribing from emails.
  • Global Privacy Control: Where required, Grux honors the Global Privacy Control (GPC) signal, though we do not currently recognize browser-initiated Do Not Track (DNT) signals.
  • Legal Bases for Processing: We process your information based on contract performance, legitimate interests, legal obligations, or your consent.

Your Privacy Rights

Regardless of your country, we respect your ability to know, access, correct, export, restrict the processing of, and delete your information. We will not discriminate against you for exercising your privacy rights.

Upon your request, we will provide access to your information, update incorrect information, delete certain information, or restrict how we process it. To exercise these rights, we will need to verify your identity. End users of an organization should direct requests to their administrator.

Privacy Information for US Residents:

  • California: Under the CCPA, you have the right to opt out of the disclosure of your personal information for cross-context behavioral advertising. We do not offer financial incentives in exchange for personal information. We do not disclose your personal information to third parties for their own direct marketing purposes under the "Shine the Light" law.
  • Nevada: We do not sell your data in accordance with Nevada Senate Bill 220, but residents may opt out of potential future sales.

We will update this Privacy Statement to reflect our data collection practices, advances in technology, or as laws require.
